This application under Section 482 Cr.P.C. has been filed seeking the quashing of the impugned order dated 10.7.2019 passed by learned Additional Principal Judge, Family Court No. 3, Muzaffar Nagar in Criminal Case No. 767/11 of 2013 (953/2012) Smt. Pooja Sharma vs. Sachin Sharma, under Section 125 Cr.P.C., whereby interim maintenance of Rs. 4,000/- per month to the opposite party no.2 and the minor son has been fixed from the date of order.
Heard learned counsel for the applicant and learned A.G.A. Perused the record.
Learned counsel for the applicant has not been able to point out any illegality or impropriety, much less than any abuse of court's process which may persuade this Court to interfere in the impugned order which reflects judicial application of mind.The provisions of interim maintenance is basically meant to avoid the prospect of destitution and vagrancy of ignored wife and children. Rs.4,000/- per month for the wife and the minor son has been fixed as a matter of interim maintenance which in the present days of price hike, cannot be said to be either excessive or disproportionate. There is no good ground to interfere in the impugned order.
The application lacks merit and stands dismissed.
