Sri A.K. Rai, learned Additional Chief Standing Counsel states that an affidavit of compliance pursuant to the order dated 15.3.2019 has filed in the Registry on 20.7.2019, the same is not on record.
Office is directed to place the same on record.
Copy of the said affidavit of compliance has been placed before us after serving the same on the learned counsel for the petitioners. In paragraphs 3 & 4 of the said affidavit sworn by Ms. Kalpana Awasthi, Principal Secretary, Government of U.P. Department of Environment, Forrest & Climate Change, Lucknow, it is clearly stated that the Department has already issued an order dated 16.7.2019 stopping the use of Trolley Based Portable Compressor Machine for felling of trees and pursuant to the said Government Order, the Principal Chief Conservator of Forest has further issued a letter dated 17.7.2019. Copies of the said letters attached to the said affidavit.
In view of the same, the relief claimed by the petitioners stands already granted. The writ petition does not require any further consideration and the same is disposed off in terms of the affidavit of compliance filed by the Principal Secretary, Government of U.P. Department of Environment, Forrest & Climate Change, Lucknow.
Accordingly, the petition is disposed off.
