Heard learned counsel for the applicant, learned counsel for the complainant as well as learned A.G.A and perused the record.
Sri Maithali Sharan Pipersenia, learned counsel for the complainant submits that in pursuance of the directions issued by Hon'ble Apex Court in the Writ Petition (C) No. 01/2020 IN RE. CONTAGION OF COVID-19 IN PRISONS, the applicant has already been released on interim bail by the court below.
Under the circumstances, the present bail application is not maintainable and is liable to be dismissed.
Accordingly, this bail application is dismissed provided, the applicant surrenders before the court below then the applicant shall have right to move a fresh bail application before appropriate forum.
