Heard learned counsel for the petitioner,the learned Standing Counsel for the State-respondents and Sri Vineet Pandey, learned counsel who has appeared for the Authority.
A preliminary objection is raised by Sri Pandey to the maintainability of the writ petition in light of a statutory alternative remedy being available to the petitioner as provided under Section 41(3) of the U.P. Urban Planning and Development Act, 1973.
Faced with this situation, Sri Kshitij Shailendra, learned counsel for the petitioner prays for liberty to approach the competent authority in the State Government by way of a revision in terms of the provision aforementioned.
This petition is accordingly disposed of with liberty to the petitioner to approach the competent authority in the State Government for filing a revision within a period of two weeks from today. It shall be open to the petitioner to also move an application in the proposed revision for grant of interim relief. In case such a revision along with a stay application is filed within the period aforenoted, the competent authority in the State Government shall endeavour to dispose of the same in accordance with law and preferably within a period of four months from the date of presentation of a certified copy of this order.
