Learned A.G.A. raised preliminary objection that vide judgment and order dated 30.07.2004 passed in Sessions Trial No.278 of 2001 arising out of Case Crime No.175 of 1998, under Sections 302/34 and 120 B I.P.C., Police Station Soron, District Etah, the applicant was summoned and the aforesaid order was challenged in Criminal Revision No.3848 of 2004 before this Court, the same was dismissed due to none presence, therefore, present application (u/s 482 Cr.P.C.) is not maintainable for the prayer is made in the present application.
Learned counsel for the applicant prays for withdrawal of the application with liberty to file appropriate application in the criminal revision.
Accordingly, the prayer is allowed.
The application (u/s 482 Cr.P.C.) is dismissed as withdrawn with the aforesaid liberty.
