The instant appeal has been preferred by Smt. Sabi Fatma (complainant) who is the wife of the deceased, Sabir Khan against the judgement and order dated 2.8.2017 passed by Additional Sessions Judge, Court No. 2, Allahabad in S.T. No. 880 of 2015, (State Vs. Akhtar and others), arising out of Case Crime No. 671 of 2015, Police Station Naini, District Allahabad whereby the accused-respondents nos. 2 to 7, namely, Akhtar, Kallu, Jamal, Gayasuddin Khan, Adanan and Nizamuddin Khan have been acquitted for the charge under Sections 147, 148, 149, 302, 201, 34 I.P.C.
By order dated 06.11.2017 the instant appeal was connected with the Criminal Misc. Application u/s 372 Cr.P.C. (Leave to Appeal) No. 314 of 2017 preferred by the father of the deceased. Since the appeal has already been admitted which was filed by the father of the deceased hence, learned counsel for the applicant submits that he wants to withdraw the instant appeal.
Accordingly, the Criminal Misc. Application u/s 372 Cr.P.C (Leave to Appeal) No. - 368 of 2017 is hereby dismissed as withdrawn.
