Respondent Prayer: Criminal Original Petition filed under Section 482 of Criminal Procedure Code, praying to modify the condition imposed in Crl.M.P.No.1859 of 2016 dated 09.11.2016, on the file of the learned Principal Sessions Judge, Dharmapuri.
For petitioners : Mr.D.Devendran For respondent : Mr.R.Sekar Govt. Advocate (Crl. Side) O R D E R This petition has been filed by the petitioners to modify the condition imposed in Crl.M.P.No.1859 of 2016 dated 09.11.2016, passed by the learned Principal Sessions Judge, Dharmapuri.
2. Petition to reduce the amount of Rs.2 lakhs directed to be paid.
3. Learned counsel for the petitioners submitted that the petitioners are very poor. They have no money. In the circumstances, the amount may be deleted or atleast it may be reduced.
4. Learned Government Advocate (Crl. Side) would submit that they were responsible for the ultimate death of the deceased.
5. Deceased is the driver of a vehicle. He is the sole bread winner of a family. Accused enjoys free boarding and lodging in jail. After some time, they comes out of jail. But, who cares for the victims. Plights of the victims also have to be considered. Court must also consider the persons affected by the criminal act. In the administration of criminal justice, Courts shall have victimological consideration. In the present case, the Court taking into account various aspects, fixed a reasonable amount.
6. In the facts and circumstances of the case, no valid ground has been made to reduce the amount.
7. In the circumstances, this Criminal Original Petition is dismissed.
