THIS WRIT PETITION IS FILED UNDER ARTICLES 226 & 227 OF THE CONSTITUTION OF INDIA, PRAYING TO QUASH THE INTERIM ORDER PASSED BY THE LEARNED 1ST ADDL. PRINCIPLE JUDGE, FAMILY COURT AT BANGALORE OF THE TRIAL COURT DATED 21.8.2013 IN CRL. MISC. NO.421/2013 VIDE ANN-A & ETC.
THIS WRIT PETITION COMING ON FOR PRELIMINARY HEARING IN ‘B’ GROUP THIS DAY, THE COURT MADE THE FOLLOWING:-
ORDER None for the parties. Record perused.
3. In this petition, the petitioner gas challenged the validity of the interim order dated 21…2013 passed by the family court by which the family court had awarded maintenance at Rs.5,000/- p.m. each to respondent Nos.1 and 2 from the date of institution of the proceedings. This Court while entertaining this writ petition hads passed an ad interim order dated 18.01.2013 by which the execution of the impugned order was stayed subject to thecondition that he petitioner shall pay a sum of Rs.3,000/- to each of the respondents during the pendency of this petition. the aforesaid order has remained in force for past more than 5 years. Therefore, at this point of time I am not inclined to adjudicate the order dated 24.08.l2013. Accordingly, the petition is disposed of with a direction to the family cout that in case the proceedings are still pending before it, the same shall be decided expeditiously preferably within a period of four months from the date of receipt of certified copy of the order passed today. Till then the interim order shall continue.
