Heard Sri Ram Raj Pandey, learned counsel for the petitioner and learned Standing Counsel for respondent nos. 1 to 3.
It is contended that on 26.06.2020, a complaint was made by one Sudhir Kumar on behalf of all the fair price license holders of Baraut, District Baghpat. The petitioner has also filed an affidavit before the authority in respect of illegal demand which was made by the Supply Inspector, on which an enquiry was initiated by the State, which is pending.
Learned counsel contended that in between the order impugned dated 17.06.2021 has been passed whereby the license of the petitioner has been put under suspension and has been directed to file reply.
Learned Standing Counsel opposing the writ petition submitted that the petitioner has approached this Court against an interlocutory order and should have filed a reply before the authority concerned which shall take decision in the matter.
Having heard learned counsel for the parties, I find that order impugned has been passed taking note of the various complaints made by card holders on which the license has been put under suspension and the petitioner has been granted opportunity to file her reply.
On the question being put to the counsel whether any reply has been furnished by petitioner or not, he was not aware of the fact.
However, it is provided that in case the final order has not been passed by licensing authority i.e. respondent no. 3 till date, petitioner may approach respondent no. 3 by way of filing reply between 15 days from today in which he shall take all the grounds available and the licensing authority thereafter within next 15 days decide the same strictly in accordance with law after affording opportunity of hearing to the petitioner.
Writ petition stands disposed of.
