Heard learned counsel for the petitioner and learned A.G.A. for the State.
Learned counsel for the petitioner has submitted that the victim herself is the petitioner in the present case and she is the deponent; as per Aadhar card, the date of birth of petitioner is 04.03.2000 and she is major; as per the FIR also, the date of birth of petitioner is 04.03.2000; she is a student of B.Sc. Ist year from Bageshwari Ramvasi Mahavidyalaya Gurwaliya, District Kushinagar; from the FIR itself, it appears that the girl is adult; further as far as main accused Tanjeer Alam is concerned, he has been arrested and he is in jail; even though she is adult and has no role to play in the present case and has gone on her own sweet will; however, police authorities are harassing the girl under the influence of her father- respondent no.3, she is not an accused in the FIR and thus prayer for seeking protection from the police has been made in the present case.
Looking into the fact and circumstances of the case that petitioner is not an accused and she is adult, her date of birth according to Aadhar Card is 04.03.2000, as such police authorities are restrained from harassing the girl in any manner whatsoever, in case her statement is to be recorded, it is directed that the concerned police station to provide lady police at the residence of the girl for recording the statement, if required.
With the above direction, present writ petition is finally disposed of.
