R.Prabhakaran vs Athulya Misra

Madras High Court|02 January, 2017

JUDGMENT / ORDER

Alleging that the order dated 09.10.2014 passed by this Court in W.P.No.20087 of 2014 has not been complied with in letter and spirit, the present contempt petition has been filed.
2.This Court has directed the second respondent in the writ petition to pass appropriate orders on the issue pending consideration for compassionate appointment qua the petitioner. By the communication dated 06.07.2016, the petitioner was informed that his name has been placed in compassionate ground appointment seniority list at Sl.No.142(a). Therefore, his name will be considered for the post of Junior Assistant soon on attaining the seniority spot.
3.Learned counsel appearing for the petitioner submits that the similarly placed person has been given appointment. If that is the case, the remedy of the petitioner lies elsewhere. This Court merely directed the second respondent in the writ petition to pass appropriate orders, which has been duly complied with. Therefore, without expressing anything on merits, this contempt petition stands closed, giving liberty to the petitioner to workout the remedy in the manner known to law.
