Heard Sri Chandrakesh Mishra, learned counsel for the applicant and learned A.G.A. for the State.
This application under Section 482 Cr.P.C. has been filed for issuing direction to A.C.J.M., Sonbhadra to expeditiously decide the Complaint Case No. 2127 of 2014 (New No. 1887 of 2016) ( Rohit Singh vs. Sunil Singh), under section 138 N.I. Act, Police Station Rabertsganj, District Sonbhadra pending before A.C.J.M., Sonbhadra.
Learned counsel for the applicant submits that in complaint case under section 138 N.I. Act the opposite party no. 2 was summoned vide summoning order dated 08.12.2014 and since he is absconding, the case is still pending.
Upon hearing learned counsel and perusal of record, the application U/S 482 Cr.P.C. is disposed of with the direction to the trial court for expeditious disposal of the complaint case after ascertaining appearance of opposite party no. 2/ the accused by execution of non bailable warrant and adopting strict coercive measures. The trial court is expected to decide the complaint case expeditiously in accordance with law, if possible, within six months.
