Heard Sri Ashutosh Mishra, learned counsel for the applicant, learned AGA for the State and perused the record.
The present 482 Cr.P.C. application has been filed by the applicant with the prayer to direct the Court below to expedite the Case No.4615 of 2014 (State Vs. Rohit Jain) arising out of case crime no.550 of 2012, under Sections 324, 504, 506 IPC, P.S. Noida Sector 58 District Gautam Budh Nagar, pending in the Court of Chief Judicial Magistrate, Gautam Budh Nagar, within a stipulated period.
It is contended by learned counsel for the applicant that the applicant is facing trial since 2014. He has referred to the certified copy of the order sheet and has pointed out that the witnesses are not turning up despite issuance of bailable and non bailable warrants against them and till date no witness has been examined by the prosecution.
In the peculiar facts and circumstances of the case, the trial Court is directed to adopt all stern action for securing attendance of the witnesses and expedite the aforesaid trial and conclude the same expeditiously strictly in accordance with law, preferably within a period of nine months from the date of production of a certified copy of the order.
With the aforesaid observations, the application is finally disposed of.
