Heard learned counsel for the applicants, learned AGA for the State and perused the record.
This application under Section 482 CrPC has been filed by the applicants with a prayer to direct the learned Special Judge (POCSO Act), Moradabad to decide the Sessions Trial No. 462 of 2015 (State Vs. Rohit @ Chhote), arising out of Case Crime No. 75 of 2015, under Sections 363, 302, 377, 201 IPC and Section 3/4 of POCSO Act, Police Station Bilari, District Moradabad within stipulated period.
Learned counsel for the applicant has submitted that charges in the present case have already been framed, however, trial has not yet been concluded and has been lingering-on, on one pretext or the other.
In view of the above, learned Special Judge (POCSO Act), Moradabad is directed to make all endeavours to decide the aforesaid trial as expeditiously as possible, preferably within a period of one year from the date of filing of certified copy of this order without giving any unnecessary adjournments to either parties and there is no other legal impediment in concluding the aforesaid trial.
With the aforesaid direction, this application under Section 482 CrPC is finally disposed of.
