Heard learned counsel for the petitioner.
By means of this writ petition, petitioner prays for a direction to the Civil Judge (Senior Division), Mathura to expedite the Original Suit No.736 of 2010 (Robin Agrawal Vs. Radha Raman), which is pending before him for disposal.
Learned counsel for the petitioner submits that he has filed the aforesaid suit in the year 2010, which is pending since then. He further submits that on 07.11.2017, witness P.W. was examined and on 29.11.2017 recall application was moved for his cross- examination, which was allowed P.W.-1 for cross-examination and thereafter P.W.-2 has been examined but for his cross- examination of the P.W.2 date is being fixed and opposite party is adjourning the case on the one or the other pretext.
From the perusal of the order-sheet annexed to the petition dated 10.11.2021, it appears that on that date the opposite party remained absent and in the interest of justice one opportunity has been provided to him.
In view of the above, it appears that the opposite party is lingering on the case on the one or the other pretext, which is evident from the order-sheet of the trial court.
Considering the submission and pendency of the suit, it is appropriate to direct the Civil Judge (Senior Division), Mathura to expedite and conclude the trial of the Original Suit No.736 of 2010 (Robin Agrawal Vs. Radha Raman) and others) and dispose of the same as expeditiously as possible without granting any unnecessary adjournments to either of the parties, preferably within a period of eight months.
