Heard Sri C.B.Singh, learned counsel for the petitioner, Sri N.K.Verma,learned A.G.A. for the State and perused the impugned FIR as well as material brought on record.
It appears from the record that admittedly the petitioner at present moment is living abroad and the Vakalatnama which has been filed along with the writ petition though stated to have been sent from abroad by the petitioner, but the witness who has signed the petition is in India, hence, the said Vakalatnama cognizance cannot be taken, to which learned counsel for the petitioner prays that the present writ petition be dismissed as not pressed with liberty to file a fresh.
Accordingly, the present writ petition is dismissed as not pressed with liberty to file fresh.
Office is directed to return the certified copy of the impugned FIR to the learned counsel for the petitioner after retaining a photocopy of the same on record.
