Heard learned counsel for the applicant, learned Additional Government Advocate for the State/opposite party no.1 and perused the record with the assistance of learned counsel for the parties.
This application under Section 482 Cr.P.C. has been filed by the applicant for quashing of the order dated 28.04.2018 passed by the learned Additional Sessions Judge, Court No. 1, Bijnor in Case Crime No. 656 of 2003, under sections 302, 304-B, 498-A IPC and section 3/4 of Dowry Prohibition Act, police station Dhampur, District Bijnor, whereby the the application under section 319 Cr.P.C. has been allowed.
At the very outset learned counsel for the applicant submitted that on account of some defects, he does not want to press this application at this stage and he may be permitted to withdraw this application with liberty to file afresh at the appropriate stage.
In view of submission made at bar by learned counsel for the applicant, this application under section 482 Cr.P.C. is dismissed as withdrawn with liberty to file afresh at the appropriate stage with better particulars.
Office is directed to return the certified copy, if any, to the learned counsel for the applicant after retaining photostat copy of the same on record as per rules.
