Heard Sri Rajeev Tiwari, learned counsel for the petitioner, learned Standing counsel for the respondent no.1 and perused the record.
By means of this writ petition, under Article 226 of the Constitution of India, the petitioner has prayed for a writ of certiorari for quashing the notice dated 7.11.2019 issued by the respondent no.3.
From the perusal of the documents that have been brought on record we find that the notice dated 7.11.2019 has been replied by the petitioner vide letter dated 14.11.2019 which has been duly served in the office of Nagar Panchayat.
In view of the above, since only notice has been issued and the petitioner has submitted reply to the said notice, we are disposing the writ petition with a direction to the Executive Officer of the Nagar Panchayat, Tirwaganj, Kannauj to consider and take a decision on the reply of the petitioner dated 14.11.2019 in respect of the notice dated 7.11.2019 within a period of three months of the production of certified copy of this order after giving due opportunity of hearing to the petitioner and that too by a reasoned and speaking order.
Until disposal of the reply submitted by the petitioner to the notice dated 7.11.2019, no coercive action shall be taken against the petitioner pursuant to the notice impugned in the writ petition.
