By order dated 10.08.2017 in Writ A No. 35574 of 2017 filed by the applicant, this Court disposed of the petition in terms of the order dated 28.01.2014 in Writ No. 4616 of 2014, directing the opposite party to consider the representation of the petitioners within four months from the date of receipt of a certified copy of the order.
There is no evidence to demonstrate that the order of the Writ Court was served upon opposite party alongwith covering letter dated 23.10.2017 as is sought to be contended before this Court. However, there is another application by way of a reminder sent to opposite party by registered post on 26.02.2018. According to the learned counsel for the applicants no decision has been taken in the matter so far.
This Court is of the opinion that before inaction on part of the opposite party in complying with the above direction is treated as wilful disobedience of the order of the Writ Court, one more opportunity be granted to him to ensure compliance of the said order.
Accordingly, the instant contempt application is disposed of with liberty to the applicant to file a certified copy of this order along with fresh representation before the opposite party and in which event, he shall ensure that compliance of the direction issued by the Writ Court is made within next eight weeks. In case the compliance is still not made, as directed herein, it shall be open to the applicants to initiate fresh contempt proceedings against the opposite party.
