1. Mr.B.S.Patel, learned advocate appearing for respondent Nos.4 to 9, on instructions, states that he does not want to press an application being Revision Application No. 77/2012 preferred by them under Section 155 of the Gujarat Co-operative Societies Act before the State of Gujarat since the order, which is challenged in the said Revision Application, is the challenge of Special Civil Application No.5000/2012 which is tagged with the present Special Civil Application.
2. Permission, as prayed for by the applicant of the Revision Application No.77/2012 is hereby granted. Revision Application No.77/2012 filed by respondent Nos.4 to 9, which is pending before the State of Gujarat, is hereby disposed of as withdrawn.
3. In the captioned petition, Reserve Bank of India has challenged an interim order dated 10.04.2012 passed by the Revisional Authority of State of Gujarat, by which, ex-parte ad-interim relief was granted in favour of revisionists/present respondent Nos. 4 to 9.
4. Since the revisionists themselves have withdrawn the Revision Application, interim order passed by the Revisional Authority does not survive, and therefore, the captioned Special Civil Application i.e.4913/2012 would become infructuous. Hence, the said Special Civil Application is treated having become infructuous and therefore, interim relief granted in the petition stands vacated. The contentions raised by either parties in the present petition as well in Special Civil Application No.5000/2012 are kept open since the Revision Application is disposed of having no final decision on it.
6. Accordingly, Special Civil Application No.4913 of 2012 is hereby disposed of. Rule is discharged.
7. Office is directed to keep the record of the present Special Civil Application No.4913/2012 along with Special Civil Application No.5000/2012, which is adjourned to 24.01.2013.
