Mr.Bipin Mehta, learned advocate waives service of rule on behalf of the respondent.

Having heard learned advocates for the respective parties, present application is allowed in terms of para - 4(b) on condition that the applicant shall issue account payee cheque in favour of respondent - Bharatbhai Lilabhai as per 60% disability on or before 07.08.2012.

Rule is made absolute to the aforesaid extent.
