Having considered the submissions advanced by Ms.Hina Desai, learned advocate for the applicant, Mr.Pravin Gondaliya, learned advocate for the respondent no.2 and Mr.K.P.Raval, learned Additional Public Prosecutor for the respondent no.1-State, it transpires that in the main matter, original petitioner no.1 has expired on 23.09.2011, and therefore, it is requested that his name may be deleted and now the petitioner no.2-Company shall be the sole petitioner.
Considering the facts and circumstances of the case, the application is allowed in terms of Para-7(A) and the name of petitioner no.1-Kishoredas Shamjibhai Mehta shall be deleted from the cause title of the main matter and the petitioner no.2-Company shall be the sole petitioner therein.
This application stands disposed of accordingly. Appropriate amendment in the main matter shall be carried out forthwith.
