Heard Sri Vidya Kant Rai, learned counsel for the petitioner, Sri Deepak Mishra, learned AGA for the State and Sri Rahul Sahai, learned counsel appearing on behalf of Indian Bank.
By means of this petition, the petitioner has prayed for quashing the impugned First Information Report dated 02.07.2018 registered as Case Crime No. 0290 of 2018 under sections 420, 467, 468, 471, 506 IPC, Police Station Sungarhi, District Pilibhit.
Sri Rahul Sahai, learned counsel for the Bank, stated that the petitioner was on the panel roll of the Indian Bank but the authority concerned has withdrawn his name on 30.6.2018 on account of his doubtful integrity.
Learned counsel for the petitioner tried to justify the conduct of the petitioner to take into account the allegation levelled in the FIR.
From the perusal of the FIR, prima facie it cannot be said that no cognizable offence is made out. Hence no ground exists for quashing of the F.I.R. or staying the arrest of the petitioner.
The writ petition is, accordingly, dismissed.
