1. Heard Sri Rajiv Lochan Shukla, learned counsel for applicant and learned A.G.A. for State.
2. This is a bail application moved by accused-applicant for enlarging him on bail in Case Crime No. 118 of 2017, under Section 302 IPC, Police Station Gambhirpur, District Azamgarh.
3. Applicant is named in the First Information Report and that role assigned to him is that he shot at maternal grandmother of Informant who died. Informant's mother, Rajpati in her statement recorded under Section 161 Cr.P.C. has specifically said that in her presence applicant shot at her mother. It is submitted that co-accused, Vinay and Banshraj have been granted bail but their role are different to that of applicant. Looking to entire facts and circumstances, I do not find it a fit case for grant of bail.
4. Application is accordingly dismissed.
