Sri Mayank, learned Advocate has filed his Vakalatnama on behalf of opposite party no. 2, the same is taken on record.
Heard learned counsels for the parties.
The contention advanced on behalf of the applicants is that matter is purely relates to the dispute between two parties regarding transaction of money and for which accounting is to be done first and therefore, a suit for accounting is the appropriate remedy for the opposite party no. 2 and no criminal element is involved in the issue in question.
Matter requires consideration. Admit.
Respondents may file their respective counter affidavits within six weeks. Rejoinder affidavit, if any, be filed within two weeks thereafter.
List immediately thereafter for further orders.
Meanwhile, until further orders, further proceedings of Case No. 1847/IX of 2018, State v. Ravindra Kumar & Others arising out of Case Crime No. 1124 of 2017, under Sections 420, 406 IPC, P.S. Highway, District Mathura including charge sheet dated 27.04.2018 pending in the court of Additional Chief Judicial Magistrate-4th,Mathura, shall remain stayed.
