Heard Shri Satish Trivedi, learned senior counsel appearing for the applicant, the learned A.G.A. and perused the record.
This bail application has been filed on behalf of the applicant involved in Case Crime No.515 of 2016 under section 302 I.P.C. PS. Khandauli, District Agra.
It is urged that witnesses, PW­1, PW­2 and PW­3, have turned hostile; applicant is languishing in jail since 6.7.2017, having no criminal history, as such the applicant is entitled to be released on bail.
Learned A.G.A. has opposed the prayer for bail submitting that as per prosecution case, main role of causing firearm injuries has been assigned to the applicant; witnesses support the prosecution version, as such, it is will not be in public interest to enlarge the applicant on bail at this stage.
Considering the facts and circumstances of the case, I am not inclined to allow the bail application.
The bail application is, accordingly, rejected.
The trial court is directed to expedite the trial and conclude the same within a period of six months from the date of production of a certified copy of this order provided there is no other impediment.
Office is directed to send a certified copy of this order to the trial court concerned for immediate compliance.
