The petitioner is judgment debtor in E.P.No.175 of 2007 filed by the first respondent for payment of money. The first respondent filed the said Execution Petition for arresting the petitioner on the ground that though he has means, he failed to satisfy the decree. During the enquiry, the first respondent examined himself as PW.1 and the petitioner was examined as RW.1 and marked Ex.R1, which is a certificate issued by Tahsildar, Kamavarapukota. Though oral evidence was let in by the petitioner, he did not rebut the documentary evidence properly. Considering the same, the Court below came to the conclusion that as per Ex.R1, the petitioner has house site admeasuring Ac.0.16 cents tiled house thereon and he cannot take the plea that he has no means to discharge the suit debt. Aggrieved by the order dated 07.11.2009 of the Court of the Junior Civil Judge, Chintalapudi in E.P.No.175 of 2007, the present Civil Revision Petition is filed.
This Court heard counsel for the petitioner and perused the revisional order. Considering the available evidence, the Court below has recorded a finding that the petitioner has sufficient means to discharge the suit debt. In the Civil Revision Petition no grounds are made out to find fault with the finding, which is neither perverse nor unsupported by evidence.
The Civil Revision Petition is misconceived and is accordingly dismissed.
