Present application under Section 482, Cr.P.C. has been filed for quashing the order dated 20.7.2019 passed by Additional Judge, Court No.2, Agra and the order dated 16.8.2019 passed by Incharge Session Judge, Agra in Complaint Case No.692 of 2012, under Section 138 of Negotiable Instruments Act.
The record reflects that in a trial under Section 138 of N.I. Act an application was filed during the course of cross examination by the accused-applicant that the witness be directed to produce the cash book, account, certificate of registration of his business and income tax returns. Said application was rejected by the trial court vide order dated 20.7.2019 on the ground that the complainant- witness cannot be directed to produce such account as the complainant has to file the evidence, which he wants to rely. Against that order criminal revision was filed, which too was dismissed vide order dated 16.8.2019 being interlocutory in nature. I do not find any illegality or infirmity in the orders impugned passed by the trial court as well as revisional court.
