Shri Mirza Ali Zulfaqar, learned counsel for the petitioner submits that the petitioner is the plaintiff in the Suit No.385 of 2018, which is pending before the Civil Judge (Junior Division), Rampur, who is aggrieved as the application 7C for temporary injunction has not been decided till date.
Learned counsel for the petitioner submits that on the application 7C, notice has been issued on 19.7.2018, however, despite the suit was listed thereafter on many dates. The defendant has not filed the objection to the said application and in these circumstances, learned counsel submits that learned court below may be directed to decide the application 7C within stipulated time period.
Considered the submissions made at Bar and perused the record. In the light of the judment passed by the Hon'ble Supreme Court in the matter of M/s Shiv Cotex vs. Tirgun Auto Plast P. Ltd and Others 2011 (89) ALR, 232, this writ petition is disposed of with the direction to learned court below to decide the aforesaid application expeditiously, preferably within a period of 8 weeks from the date of production of certified copy of this order, without granting any unnecessary adjournment to either of the parties.
