Heard Sri Siddhartha Srivastava, learned counsel for the petitioners.
In Original Suit No. 540 of 2012 (Bahadur Singh Vs. Ratan Singh) several issues have been framed and one of them being whether the Court has jurisdiction to hear the said suit. The said issue no. 6 has been decided against the petitioner and revision against the same has already been dismissed. Therefore, the petitioner has preferred this petition.
Each and every issue decided in a suit can not be permitted to be challenge independently when the suit itself is pending before the trial court.
The petitioner if aggrieved by the decision of any issue in a suit, can challenge it at the time of filing an appeal by taking a ground to that effect in the suit.
In view of the above, I am not inclined to interfere in the matter at this stage,lest it may hamper the progress and the decision of the suit.
The petition as such is dismissed.
