A supplementary affidavit has been filed bringing on record the application alleged to have been filed by the applicant before the opposite party under Section 128 of the U.P. Cooperative Societies Act, 1965. It is alleged that despite specific direction by this Court dated 4.12.2017 in Writ Petition No.57587 of 2017, the same has not been decided so far.
A perusal of the order of the Writ Court reveals that while issuing direction to decide the application, no time frame was fixed, as such this Court is not inclined to proceed in contempt against the opposite party, but leaves it open to the applicant to file certified copy of this order before the opposite party with a request to decide the application within 12 weeks. In the event, decision is still not taken, it shall be open to the applicant to approach this Court by way of fresh petition.
The contempt application stands disposed of accordingly.
