Heard Sri Ashutosh Kumar Mishra, learned counsel for the applicants and Sri Ashish Pandey, learned AGA for the State.
This application u/s 428 Cr.P.C. has been preferred with the prayer to quash the entire proceeding as well as charge sheet dated 22.5.2017 in case no. 885 of 2017 (State Vs. Rashid Pahalwan and others) arising out of case crime no. 132 of 2017, under section 147, 148, 149, 452, 307, 323, 336, 504, 506 IPC, P.S. Kotwali Nagar, District Aligarh, pending in the court of A.C.J.M. I, Aligarh.
After arguing the matter at some length, learned counsel for the applicants prays that the present application be rejected as withdrawn without any liberty to file the same.
This application is accordingly rejected without any further liberty to file a fresh petition for the same cause of action.
