Heard learned counsel for the applicant, and learned A.G.A. for the State.
This bail application has been moved by the accused-applicant Ranvir @ Rannu who is involved in Case Crime No. 469/2017, under Sections 302, 201 and 34 I.P.C., Police Station Seohara, District Bijnor.
As per prosecution version, on 07.09.2017 co-accused Monu, Manoj, Kripal Singh and Visam Pal have committed murder of Smt. Jyoti Devi wife of Monu. F.I.R. has been lodged on the same day at 11:45 p.m. against above named persons. During investigation, the name of applicant and co-accused came into light.
It is contended by learned counsel for the applicant that he has been made accused on the basis of confessional statement of co-accused Dalveer Singh before police. He further submitted that Munne and Diwan Singh are the witnesses of last seen. They named applicant with co-accused Amar Singh in their statements under Section 161 Cr.P.C. Co-accused Amar Singh has been granted bail by this Court vide order dated 13.12.2017, passed in Criminal Misc. Bail Application No. 48947/2017, copy of perused for perusal. The appellant has no criminal history and the role of applicant is similar to that of co-accused Amar Singh.
Learned A.G.A. has opposed the prayer for bail and admitted this fact that applicant has been made accused on the basis of confessional statement of co-accused Jasveer Singh and statements of above named witnesses.
The role of applicant is similar to that of co-accused Amar Singh. Applicant is not named in F.I.R.
Without expressing any opinion on the merits of the case and considering the facts and circumstances of the case, I find it a fit case for enlarging the applicant on bail.
Let the applicant Ranvir @ Rannu be released on bail in the aforesaid case crime number on furnishing a personal bond and two reliable sureties of the like amount to the satisfaction of the Magistrate concerned.
Accordingly bail application is allowed. Order Date :- 26.2.2018 Sharad/-
