The instant petition has been filed seeking a direction to the trial Court to decide Original Suit No. 675/2003, expeditiously.
Counsel for the petitioner submitted that the suit is pending since the year 2003. The evidence of the petitioner is over long back and the defendant is deliberately delaying the disposal of the suit by seeking unnecessary adjournments. In support of the said contention, he has placed reliance on order dated 15.2.2018, on which date the adjournment application filed by the defendant was allowed on payment of a cost of Rs. 150/-. He points out that in the year 2013, the petitioner has filed a petition bearing No. 2170 of 2013 and it was disposed of with liberty to the petitioner to file an application before the Court below for expeditious disposal. It is urged that since then about five years have passed, but still the suit has not been decided.
Having regard to these facts, the instant petition is disposed of by directing the trial Court to make all endeavour to conclude the proceedings of the suit expeditiously, by fixing short dates and without granting unnecessary adjournments.
