Ranuj vs State

High Court Of Gujarat|15 March, 2012

JUDGMENT / ORDER

By way of present revision application, filed under Section 397 read with Section 401 of the Code of Criminal Procedure, the applicant has prayed to quash and set aside the judgment and order of acquittal dated 07th January, 2012 passed by the learned Additional Chief Judicial Magistrate, Mehsana in Criminal Case No.3069 of 2005.
Heard Mr.Gaurang Bhatt, learned counsel for the applicant and Mr.H.L. Jani, learned Additional Public Prosecutor for the respondent-State.
It appears that against the order of acquittal passed by the learned Chief Judicial Magistrate, Mehsana the applicant has directly moved before this Court without filing any criminal appeal against the order of acquittal. Mr.Bhatt states that State is likely to file appeal against the order of acquittal, to which Mr.Jani, learned Additional Public Prosecutor, states that he has no knowledge about filing of any appeal against the order of acquittal.
In view of above, present revision application is disposed of as not maintainable. The applicant may move before the appropriate Forum with appropriate proceedings.
