This transfer application has been filed by the wife-applicant seeking transfer of Case No.440 of 2020 (Ravi Kumar vs. Ranjita) under Section 9 of Hindu Marriage Act filed by the husband-opposite party, pending before the Court of Principal Judge, Family Court, Ambedkar Nagar to the competent Court at District Gorakhpur.
In my opinion, since the transfer of petition instituted at District Ambedkar Nagar has been sought, which falls within the territorial jurisdiction of Lucknow Bench of this Court, therefore, the present application is not maintainable at principal seat of Allahabad High Court.
At this stage, counsel for the applicant submits that he intends to withdraw the present application with liberty to file fresh transfer application at High Court, Lucknow Bench, Lucknow.
In view of the above, the instant application is dismissed as withdrwn with liberty, as prayed for.
