Heard learned counsel for the petitioner, Sri Devesh Vikram, learned Standing Counsel for the State-respondents and Shri Vijay Kumar Dixit, learned counsel for the respondent Nos. 3 to 5.
In pith and substance, petitioner is before this Court for a direction in the nature of mandamus directing the respondent No. 3 and 4 to forthwith release the amount of gratuity as admissible to the late husband of the petitioner.
Learned counsel for the respondents on the basis of instructions apprised the Court that the pension of the petitioner has been ensured but sofar as the other retiral dues are concerned, the same has yet to be paid. On account of financial crises, the same cannot be ensured.
In view of the above, on consent and without expressing any opinion on the merits of the issue and considering the facts and circumstances of the case, this writ petition is disposed of finally asking the competent authority to ensure the admissible payment of retiral dues in accordance with law within three months from the date of production of a copy of this order failing which, the petitioner will be entitled for 8% interest on the delayed payment.
The party shall file computer generated copy of such order downloaded from the official website of High Court Allahabad, self attested by the petitioner alongwith a self attested identity proof of the said person (preferably Aadhar Card) mentioning the mobile number to which the said Aadhar Card is linked.
The concerned Authority/Official shall verify the authenticity of such computerized copy of the order from the official website of High Court Allahabad and shall make a declaration of such verification in writing.
