Heard learned counsel for the petitioners and learned standing counsel for the respondents.
This petition under Art. 226 of the Constitution, has been filed seeking a direction to the respondent nos. 2 to 5 to reinstate the Examination Centres of the Institutions in question for conducting the Board Examination for the 2020 and allot the same as per the tentative list published on 12.11.2019.
It is contended by learned counsel for the petitioners that the Petitioners' Institutions/Colleges applied for the examination centre for conducting the Board Examination for the year 2020 and the District Inspector of Schools, Etah vide letter dated 31.10.2019 recommended the names of the petitioners' Institution/Colleges but in the final is issued by the Secretary, Madhyamik Shiksha Parishad,U.P., Allahabad dated 30.11.2019 names of the petitioners-institutions do not find place. It is further submitted that petitioners represented the matter within time under the Government order dated 16.10.2019 i.e. on 2.12.2019, copy of the same has been appended as Annexure-6 to the writ petition which is still lying undecided.
No useful purpose would be served by calling a counter affidavit and keep this petition pending.
Therefore, in the facts and circumstances of the case, this petition is being finally disposed of by issuing a direction to the respondent 3- Secretary, Madhyamik Shiksha Parishad,U.P., Allahabad to decide the petitioners' representation dated 2.12.2019, appended as annexure-6 to the writ petition, in accordance with law expeditiously within a period of three weeks from the date of production of a certified copy of this order.
