Heard learned counsel for the petitioner, Ms. Archana Singh, who has appeared for the respondent No. 4 as well as Sri Rajesh Kumar Srivastava for the respondent No. 3.
Learned counsel for the parties do not dispute that the provisions of Rule 9(3) of the Security Interest (Enforcement) Rules, 2002 are mandatory. Learned counsel for the petitioner has also not been able to draw the attention of the Court to any precedent which may have held its provision to be directory and a default in deposit of 25% liable to be condoned.
In view thereof, the Court finds no ground to interfere with the order impugned.
The petition is dismissed.
