Heard learned counsel for the revisionist, learned counsel for the opposite party no.2 and learned A.G.A. for the State and perused the material placed on record.
The present criminal revision has been moved against impugned order dated 10.01.2020 passed by learned Special Judge (POCSO Act), Ghaziabad in Criminal Case No.125 of 2017 (State Versus Ramu @ Rajkumar) arising out of Case Crime No.405 of 2017 under Sections 363, 366, 376(2)(A), 328 I.P.C. and 5/6 of POCSO Act, Police Station Loni, District Ghaziabad whereby learned court below has rejected the application of the revisionist moved under Section 311 Cr.P.C.
Having heard learned counsel for the parties and perused the material on record, this Court does not find any ambiguity, illegality, irregularity or perversity in the order of trial judge rejecting the application of the revisionist moved under Section 311 Cr.P.C.
However, this revision is disposed of finally with the observation that if the applicant moves another application assigning good reasons to recall a witness, that application shall be disposed of as per law.
