This writ petition has been filed by the petitioner praying for quashing of the order dated 25.09.2017, by which the fair price shop licence of the petitioner has been suspended and the order dated 01.02.2018 passed by the Licensing Authority cancelling the fair price shop in question.
Against the orders impugned, the petitioner has an adequate statutory remedy of filing an Appeal under paragraph 13(1) of the U.P. Essential Commodities (Regulation of Sale and Distribution Control) Order, 2016.
The writ petition is dismissed on the ground of availability of statutory remedy alone.
However, it shall be open for the petitioner to take all legal or factual grounds available to him before the Appellate Authority in appeal.
