Petitioner is permitted to implead concerned Sub Divisional Magistrate as respondent no.5 in the writ petition. Notice on behalf of said respondent is accepted by learned Standing Counsel.
In the facts and circumstances of the present case remedy of the petitioner would be to approach respondent no.5 in respect of his grievance by way of an appropriate application under section 65 of the U.P. Revenue Code, 2006. In the event such an application is moved the authority concerned shall get the matter inquired into and take necessary action in accordance with law.
Writ petition is, accordingly, disposed off.
