Heard learned counsel for the petitioner, Sri S.K. Mishra, Advocate holding the brief of Sri R.P. Pandey, learned counsel and learned Standing Counsel representing the respondent nos. 1,2 and 3.
With the consent of the counsels for the parties, the writ petition is disposed of.
The petitioner was disbursed the loan of Rs. 7,43,553/- by the respondent no. 4- Bank under the Kishan Credit Card (K.C.C.) Yojana.
It is submitted by the counsel for the petitioner that a sum of Rs. 55,500/- have been paid by the petitioner on 31.03.2016. Since the remaining principal amount plus interest has not been paid by the petitioner a recovery citation dated 04.12.2018 has been issued by the Tehsildar, Tehsil Devband, District Saharanpur, a copy of the recovery citation is enclosed as annexure 1.
Learned counsel for the petitioner submits that the petitioner is ready to pay the principal amount plus interest in instalment.
Having heard the counsel for the parties and as consented, this Court directs the petitioner to pay a sum of Rs. 2,00,000/- on or before 15th June, 2019 as first instalment. The second instalment of Rs. 2,00,000/- will be paid by the petitioner by 15th July, 2019 and the third instalment of Rs. 2,00,000/- will be paid by the petitioner by 14th August, 2019. On payment of third instalment, the respondent- Bank will provide the statement of account to the petitioner by 20th August, 2019 and thereafter the petitioner will pay the remaining amount disclosed by the respondent- Bank on or before 15th September, 2019.
In default of any above conditions, this order automatically stands vacated.
If the petitioner complies with the aforesaid conditions, no coercive action shall be taken against the petitioner for recovery of the said amount.
No recovery charges shall be recovered from the petitioner, if the petitioner complies the above conditions.
With the above observation, the writ petition is disposed of.
