The plaintiff of Original Suit No. 400/2015 has filed the instant petition seeking a direction to the trial Court to expedite the disposal of the application filed by him under Order 39, Rule 2-A CPC, registered as Misc. Case No. 126/2015.
It is submitted by learned counsel for the petitioner that the application is pending since August 2015. The opposite party has been served by publication.
Having regard to the facts of the case and the submissions made, the instant petition is disposed of by directing the trial Court to decide the application, expeditiously, without granting unnecessary adjournments.
