JUDGMENT / ORDER

Rule.
Ms. Shah waives service of notice of Rule on behalf of respondent State.
The applicant convict Ramjibhai Cheharji Thakor has filed this application through Kapoorben Ramjibhai Thakor, who happens to be the niece of convict for temporary bail on the ground that the real brother of the applicant convict has expired on 3/1/2012.
I have perused the death certificate annexed with the application as well as jail record of the convict, which reveals that the jail conduct of the convict is satisfactory and he has surrendered in time whenever he was released earlier on temporary bail or furlough leave.
In view of the above, I am of the opinion that the application is required to be considered. Hence, the application is partly allowed. The applicant - convict is ordered to be released on temporary bail for a period of three weeks from the date of his release on his executing a personal bond of Rs. 5,000/- to the satisfaction of the jail authority. He shall surrender to the jail authority on expiry of the temporary bail period.
Rule is made absolute accordingly. Direct service today is permitted.
