The writ petition has been filed for the following relief :-
"(i) issue a writ, order or direction in the nature of mandamus directing to the respondent no.3-District Consumer Protection Forum, Ballia for deciding the Complaint No.158 of 2011 (Ramgulam Prasad vs. Allahabad Bank Branch, Ballia), dated 28.6.2011 pending before him as early as possible within a month."
Heard learned counsel for the petitioner, Shri Habib Ahmad, learned counsel for respondent no.4, learned Standing Counsel and perused the record.
Learned counsel for the petitioner submitted that complaint filed by the petitioner bearing Complaint No.158 of 2011, dated 28.6.2011, before respondent no.3 - District Consumer Protection Forum, Ballia has not yet been decided and is pending since last 8 years despite the pleadings are completed. It is further submitted that the same be decided within stipulated time period.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the case, this writ petition is finally disposed of with a direction to the petitioner to make a fresh application for early hearing, before respondent No. 3, District Consumer Protection Forum, Ballia, within 15 days from today along with a certified copy of this order and, if any such application is made, the said authority shall make all endeavours to consider and decide the same in accordance with law expeditiously preferably within three months from the date of receipt of the said application provided there is no legal impediment.
