Heard Sri H.N. Singh, learned Senior Advocate assisted by Sri Vineet Kumar Singh, learned counsel for the petitioners, Sri Rajeev Singh learned Standing Counsel for the State-respondents and Sri Vivek Saran, learned counsel representing respondent nos.2 and 3.
In view of the order proposed to be passed, we do not deem it fit to issue notice to respondent nos.4 to 7 as their interest, if any, would be protected under the directions issued by us.
With regard to the grievance relating to compounding of the constructions made by the petitioners which, admittedly, are in violation of the bye-laws, without sanction of the building plan and contrary to the land use, the petitioners may make an appropriate representation before the Housing Commissioner-respondent no.2 along with a certified copy of this order and all relevant material as petitioners may deem fit in their support whereupon the said Authority shall take an appropriate decision, strictly in accordance with law within a period of six weeks from the date of production of a certified copy of this order, after affording due opportunity of hearing to the petitioner and respondent nos.4 to 7.
The petition stands disposed of as above.
