1. Learned advocate Mr.Pramthesh D. Dave places on record the certificate dated 18.4.2015, wherein a note is written under the signature of In-charge Principal, Sankalchand Patel College of Engineering which says that so far as first term fee for the academic year 2014-15 is concerned, same is Rs.30,000/-, of which Rs.20,000/- were paid at the time of admission and Rs.10,000/- were paid later on. But, second term fee of Rs.30,000/- is not paid till date.
2. The present application is filed by the convict through his son seeking temporary bail for a period of 30 days so as to Page 1 of 3 R/CR.MA/7154/2015 ORDER see that fees could be paid for the second term of the academic year 2014-15.
3. Learned APP Mr.Patel drawn attention of the Court to jail remarks. The convict had availed temporary bail on various occasions and reported in time. He has also enjoyed furlough and reported in time.
4. The matter requires consideration.
5. Rule. Learned APP Mr.H.K.Patel waives service of Rule on behalf of Respondents.
6. For the contents of the application, the same is allowed. The convict is ordered to be released on temporary bail for a period of three weeks from the date of his release, on his executing a personal bond of Rs.5,000/- (Rupees Five Thousand Only) to the satisfaction of the Jail authorities and also on observing other usual terms and conditions.
7. The convict shall surrender to the Jail authorities on expiry of the temporary bail period.
8. Rule is made absolute to the aforesaid extent.
9. On a request made by learned advocate Mr.Pramthesh D. Dave , the Registry is directed to communicate this order to the jail authority.
