Heard Sri Suresh Chandra Dwivedi, learned counsel for the applicant, Sri I.P. Srivastava, learned A.G.A. for the State and perused the record.
This is the second bail application filed on behalf of the appellant. The first bail application of the appellant was rejected by a co-ordinate Bench of this Court on 4.1.2013.
It has been contended by the learned counsel for the applicant that one Pramod on whose information the dead body was recovered from the well was not produced for the recording of the statement. It has been next submitted that the injuries on the dead body are simple in nature and the well is situated in the residential house of the appellant. The appellant is in jail since 7.7.2011.
Learned counsel for the complainant as well as learned A.G.A. have vehemently opposed the prayer for bail and submitted that the first bail application of the appellant was rejected on merits. It has been next submitted that the dead body was recovered from the premises of the house where the well was situated.
Without expressing any opinion on the merits of the case and considering the submission advanced, I find no good ground for grant of bail to the applicant Ramesh involved in S.T. No. 33 of 2007 (State vs. Nawab and others) in Case Crime No. 261 of 2003 under Section 364, 302, 34, 201 I.P.C., police station Kotwali Karvi, District Chitrakoot and in S.T. No. 34 of 2004 (State vs. Ramesh) Case Crime No. 275/2003 under Section 4/25 Arms Act, Police Station Kotwali Karvi, District Chitrakoot.
Accordingly, the bail application is rejected.
However, the trial court is directed to expedite the trial of the aforesaid case and conclude the same within preferably a period of six months from the date of production of a certified copy of this order, if, there is no legal impediment.
