JUDGMENT / ORDER

Learned advocate for the applicants seeks permission to delete the respondents No.3 and 5 from the array of respondents. Permission as prayed for is granted. The respondents No.3 and 5 shall stand deleted from the array of respondents.
By this application, the applicants seek permission to bring on record of Miscellaneous Civil Application No.2066 of 2010 the respondents No.1(1) to 1(4) in place of deceased respondent No.1 - Mukundlal Sukhlal Shah and to amend its record accordingly.
Heard Ms. Khyati Hathi, learned advocate for the respondents and Mr. Rutviz Oza, learned advocate for the respondents No.1(1) and 1(5).
Having regard to the averments made in the application it is apparent that the respondent No.1 - Mukundlal Sukhlal Shah has expired on 20.11.2010 and as such, it would be necessary to bring his heirs and legal representatives on record of the miscellaneous civil application.
In the circumstances, considering the ground stated in the memorandum of application, the application is allowed. The applicants are permitted to bring on record of Miscellaneous Civil Application No.2066 of 2010 the respondents No.1(1) to 1(4) in place of deceased respondent No.1 - Mukundlal Sukhlal Shah. The application stands disposed of accordingly.
Registry to amend the cause title accordingly.
